Visibility from Bistro AreaThe pokie room is not visible from inside Brady's Bistro. There is a large blue neon sign above the entrance to the Two Chefs area stating "Through to Gaming Room". This sign is visible throughout Brady's Bistro.
There is no warning sign on this door to restrict children from entering. Once inside Two Chefs which includes an eating and food serving area, there is both pokies sound and vision.

General CommentsIn April 2006, the VCGR approved the grant of 8 additional pokie licenses for this venue. Amendments to local government town planning schemes since April 2006 would likely prohibit such applications for more pokies as this venue appears to be located in a strip shopping area.

Furthermore, one of the basis for approval mentioned by the VCGR in approving this application may well have been reversed by the Victorian Supreme Court in its decision regarding the Romsey Hotel. It is not suggested that the VCGR's decision in this matter was incorrect. Rather, that the tests for approval have changed.
In approving the Hampton Park application the VCGR stated:
"Nothing adverse was suggested in relation to the hotel, particularly as to issues of problem gambling."
At that time, the VCGR restricted its consideration of whether an application had an adverse affect on the community by confining its examination to the effect of further pokies on problem gamblers only. It was properly following the decision of Morris J. in the Branbeau matter. This means of considering applications for more pokies was rejected.
